This document sets out the guidelines for how Lemlist Referral will communicate with its users, including the methods of communication that will be used. It also outlines the requirements and standards that Lemlist Referral must follow in order to comply with the Telephone Consumer Protection Act (TCPA).

Lemlist Referral should carefully read and understand the terms and conditions outlined in this Agreement, as it contains vital information about our communication policies. It’s essential to note that this Agreement includes a mandatory arbitration provision, which mandates the use of arbitration on an individual basis for dispute resolution instead of jury trials, court proceedings, or any form of class actions.

At Lemlist Referral, we take your privacy seriously and want you to understand how we collect, use, and protect your information when you use our website or any other media channels related to our company. This Communication Policy outlines these practices, and we urge you to read it carefully. If you don’t agree with our policies, we ask that you refrain from using our services.

Lemlist Referral may utilize different communication channels, such as SMS, social media platforms like Facebook, Instagram, Twitter, Pinterest, or messaging apps like Whatsapp, Viber, WeChat, emails, mobile applications, and any other available channels to communicate with you on behalf of ourselves, our affiliates, and advertisers.

When you use Lemlist Referral’s website, you give us permission to contact you and send you telemarketing promotions for products or services through various means, such as automatic dialing systems, prerecorded voices, and text messages, using the phone numbers you provided. These promotions may be for products or services beyond those you are interested in, but may be of interest to you. It is important to note that agreeing to this policy is not necessary for you to purchase any goods or services.

Lemlist Referral may change this Communication Policy at any time without prior notice to you. If you continue to use the Site, you agree to the updated Communication Policy. The “Last Updated” date at the top of this page will indicate the most recent changes to the policy.

Lemlist Referral reserves the right to change or discontinue any of its communication program(s) without notice or liability to you. Additionally, Lemlist Referral and its related companies, as well as each of their respective officers, directors, employees, and consultants, are not responsible and shall not be liable for any losses or injuries of any kind resulting, directly or indirectly, from any Lemlist Referral communication or from technical failures or delays of any kind. Finally, Lemlist Referral reserves the right to cease delivery of any communication to any person at any time in its sole discretion, and the wireless carriers or service providers are not liable for any delayed or undelivered text alerts.

Lemlist Referral.com and its affiliates may offer SMS (Short Message Service) and MMS (Multimedia Message Service) text alerts related to a user’s orders and product delivery services. These text alerts are sent by Lemlist Referral or its third-party vendors. To sign up for text alerts, a user must provide their mobile phone number, including the area code. By signing up for text alerts, the user agrees to the terms and conditions, which become effective upon enrollment.

The customer acknowledges that text alerts will be sent to the mobile phone number provided to Lemlist Referral and that they may include limited personal information about their orders and/or product delivery. Anyone who has access to the mobile phone or carrier account will also be able to see this information. The frequency of text alerts sent to the customer will vary, typically when there is information about a product or other relevant information. Lemlist Referral does not impose a separate charge for text alerts, but the customer’s mobile carrier’s message and data rates may apply based on their mobile phone contract’s terms and conditions. The customer is responsible for all message and data charges incurred and should contact their mobile service provider about such charges.

Additionally, Lemlist Referral and its affiliated companies, as well as their respective officers, directors, employees, and consultants, are not liable for any losses or injuries resulting from any Lemlist Referral communication or technical failures or delays. Finally, Lemlist Referral may stop delivering any communication to any person at any time in its sole discretion, and wireless carriers or service providers are not responsible for any delayed or undelivered messages.

Moreover, Lemlist Referral and its related companies, officers, directors, employees, and consultants are not responsible for any losses or injuries resulting directly or indirectly from any communication or technical failures or delays of any kind. Lemlist Referral also reserves the right to cease delivery of any communication to any user at any time in its sole discretion, and the wireless carriers or service providers are not liable for any delayed or undelivered communication.

Lemlist Referral’s consent requirements depend on the type of conversations they have with their clients, such as Conversational, Informational, or Promotional, and the nature of the conversation, such as Transactional or Promotional. Conversational SMS/text messaging involves a two-way communication between the company and its existing customers or contacts with an existing business relationship. If a customer initiates the conversation and the company responds promptly with a single message containing relevant information, it is considered a Conversational message, and implied consent is assumed. Thus, verbal or written permission is not required.

Informational SMS & Voice Recordings

Informational SMS/Text & Voice Messages are sent when a customer provides their phone number to the company and gives permission to be contacted in the future. To receive informational text messages, customers must explicitly consent to receiving texts for this purpose. This consent may be given via text opt-in, on a form, on a website, verbally, or in writing.

Promotional SMS/Text Messaging

Promotional Text Messaging is the act of sending text messages that advertise and market a business’s products or services. To receive promotional text messages, contacts may fill out a form, check a box online, or take other actions that indicate their agreement to receive such messages.

Text Message Calls-to-Action (CTAs)

CTA (Call-to-Action) is a feature utilized in SMS text messages that encourages recipients to take certain actions, like clicking on a button or link. For Lemlist Referral, CTAs are used to share information about services and promotional content with clients. Clients can opt-out of these messages at any time by texting a keyword such as “STOP” or indicating that they do not want to receive such communications.

Call Recording:

At Secctem Referral, we use a telephone system that records incoming and outgoing calls for lawful purposes, including quality monitoring, training, compliance, and safeguarding. We collect, retain, and/or record calls as necessary, and access to such calls is limited to specific circumstances, such as addressing complaints, conducting management quality checks, ensuring quality standards, ensuring safety, verifying regulatory compliance, and for safeguarding and employee training purposes. All personal data collected during call recording will be processed in compliance with relevant laws and regulations, including GDPR. We ensure that all data collected is relevant, adequate, and not excessive, and that only authorized senior and managerial staff have access to it. All data is managed confidentially, kept secure, and securely destroyed after its intended purpose has been served.

Lemlist Referral may collect personal information, including your name and contact details, when you participate in contests, giveaways, or surveys. We may release this information to respond to legal processes or to investigate potential violations of our policies or to protect the rights, assets, and safety of others. Such disclosure may be required or allowed by applicable laws, rules, or regulations, including sharing information with third-party entities for fraud prevention and credit risk reduction. We will handle your personal data in accordance with applicable laws and regulations, and only authorized personnel will have access to it. We will keep your information confidential, secure, and will only retain it for the duration necessary to fulfill its purpose.

Lemlist Referral may share your information with third-party service providers who conduct services for us, such as payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance. We may also disclose your information to third parties for marketing purposes, provided that you have given your consent or have the option to withdraw consent, as permitted by law.

When you interact with other users of the Site and our mobile application, they may be able to view your name, profile picture, and activity descriptions, including invitations, chats, likes, and blog following.

Any comments, contributions, or other content that you post on the Site or our mobile applications may be publicly visible to all users and may be distributed outside of the Site and our mobile application indefinitely.

We may use third-party advertising companies to display ads when you visit our Site or mobile application. These companies may collect information about your visits to our Site and other websites using web cookies to display ads tailored to your interests.

Additionally, we may share your information with our affiliates, such as our parent company, subsidiaries, joint venture partners, or any other companies under our control or that are under common control with us. However, this is subject to compliance with our Privacy, Communication Policy, Terms of Use, and other relevant policies.

This section describes the process for resolving any disputes that may arise between the user and Lemlist Referral in connection with their agreement. Unless the dispute qualifies for small claims court, any disputes will be settled through final and binding arbitration before a neutral arbitrator. This arbitration will be conducted on an individual basis, and class arbitrations and actions are not allowed. The arbitrator will follow the Consumer Arbitration Rules of the American Arbitration Association, as modified by this agreement. The arbitrator’s decision will be final and binding and may include injunctive relief or specific performance of the agreement, but only to the extent necessary for the individual claim.

If any part of this Dispute Resolution provision is found invalid or unenforceable by a court, the remaining parts of this provision will still apply. However, if the language pertaining to the waiver of class and representative actions is deemed invalid or unenforceable, the entire Dispute Resolution provision will be void. This severability provision will not affect the rest of the agreement, which will remain in effect.

Additionally, this agreement does not prevent the user from bringing any issues to the attention of federal, state, or local agencies, who may seek relief against Lemlist Referral on the user’s behalf, if permitted by law.
